Description: Learn about drafting legislation and regulations.  This popular course is divided into two classes. The first class will focus on legislative drafting, beginning with policy formulation and analysis and continuing through the fundamentals of bill organization, proper drafting style, and freestanding versus amendatory bills.  The second class will focus on regulation drafting, including administrative law principles, the “anatomy” of a rule, and options available in the drafting process.  Both classes will include exercises to help participants develop their drafting skills.
 
Part 1 - Statute Drafting

Description: The first class in this series concerns the drafting of legislation for the U.S. Congress.  Those who attend will learn who actually puts together the legislative text.  Consider the sorts of questions and analysis necessary for translating ideas into legislative proposals.  Our distinguished presenter will discuss the organization of a prototypical bill, proper drafting style, and the drafting of freestanding versus amendatory provisions.  Participants will be given in-class exercises to try their hand at developing and analyzing policy and turning it into a bill.
 
Part 2 - Regulation Drafting

Description: This class will begin with an introduction to relevant administrative law principles that affect the drafting of regulations, including the informal rulemaking process under the Administrative Procedure Act.  Those who attend will learn about the “anatomy” of a rule including preamble requirements, common drafting issues for regulation text, and options available in the drafting process.  Attendees will draft a regulation under the legislation drafted in Part 1 of this series.
