Description: Suspension and debarment from federal contracting, grants, and programs can be a “corporate death penalty” for a contractor or grantee, and it can make an individual unemployable. This class is a primer for representing clients facing potential suspension or debarment. Our knowledgeable panel will explain the regulatory regime governing suspension and debarment, including the various causes for which an agency can suspend or debar a contractor or program participant, and the mitigating factors that may enable a respondent to avoid suspension or debarment. They will also discuss, from a practical perspective, how suspension or debarment actions proceed before an agency and how to defend them. These issues will be discussed from both the perspective of representing a corporate respondent and of representing individuals. Finally, the panel will address the availability of judicial review of agency suspension and debarment decisions and a review of the caselaw useful in representing clients in suspension and debarment cases.
