This class will explore the current state of the law of sexual harassment claims. We will discuss the evolution of the law of sexual harassment, and explore the legal requirements for meeting each of the essential elements of both a hostile environment and a quid pro quo claim of sexual harassment. Our experienced faculty will discuss the nuances of a same-sex sexual harassment claim, as well as the current status of the courts’ willingness to recognize claims for transgender harassment and sexual orientation harassment. They will explore the concepts of “unwelcome” and “severe or pervasive” and how courts have interpreted these legal requirements. In addition, the faculty will discuss the requirements for defendants to mount an affirmative defense as introduced in the Ellerth and Faragher Supreme Court decisions, and the legal issues presented therein. The faculty will present an in-depth hypothetical with a sophisticated workplace sexual harassment scenario and invite audience participation in the discussion. Finally, they will discuss the most recent headline-grabbing sexual harassment scandals and discuss important lessons learned.
