Description
A Lawyer’s Ethical Duties to Understand Metadata, Digital Evidence in the Cloud, and More
(This is a downloadable PDF document)

Course book from CLE class presented on March 20, 2017.

Description: This class explores the ethical duties of lawyers to understand and use technology in their law practice. This has become a growing issue across the country, especially with the December 2015 changes to the Federal Rules of Civil Procedure and the emphasis on proportionate and relevant e-discovery. The class will discuss Comment 6 to the ABA Model Rules of Professional Conduct stating that lawyers should keep up with changes in the law and its practice, "including the benefits and risks associated with relevant technology.” From metadata to electronically stored information (ESI), find out how much of the technology you need to know.
