Underused or Misunderstood Rules of Evidence:  Making Them Work for You

Course book from CLE class presented on March 29, 2017.

Description: Gain familiarity with rules of evidence that tend to be underused or misunderstood by practitioners.  Our faculty will explain the relevant Federal Rules of Evidence and describe the situations in which D.C. common law departs from the federal rules.  They will provide relevant case law and give practical suggestions – including a few brief demonstrations – for making use of these rules at trial or in evidentiary hearings.  The class will apply to both civil and criminal litigation.  The faculty will focus on:
• Preliminary questions and conditional relevance
• Rule of completeness
• Judicial notice
• Present recollection refreshed vs. past memory recorded
• Best evidence rule and the difference between originals and duplicates
• Lay opinion testimony
• Expert opinion on ultimate issue.
