EPA's regulation of coal ash under the Resource Conservation and Recovery Act is in flux. In August, the D.C. Circuit ruled on challenges to EPA's coal ash regulations, affirming, remanding, and vacating different components of the regulations. A new lawsuit challenging EPA's more recent regulatory efforts was just filed. And the impacts of Hurricane Florence on coal ash ponds heightens the focus on these issues. Our panel of distinguished environmental law practitioners will discuss these recent developments and look ahead to what steps the agency might take next and how the regulatory landscape will continue to evolve.
