Description: The use of virtual or cryptocurrency has become very commonplace.  Everyday scenarios include:
 
  • An individual purchasing a cup of coffee with an app that accepts cryptocurrency
  • “Miners” setting up businesses
  • Individual traders that exchange coins for gain
    Initial coin offerings for start-up companies
    U.S. businesses having a back-up fund, in case of a cybersecurity attack and ransom.
So, what does a legal professional need to know to assist a client that has a U.S. cryptocurrency tax issue?  This timely and informative presentation explores the basics of cryptocurrency: its history, types of coins, valuation, documentation, cryptocurrency events, available IRS and FinCEN guidance, and general tax treatment.
 
Our knowledgeable and experienced presenter will then discuss more advanced topics such as mining, use of cryptocurrency within a business (whether domestic or foreign), initial coin offerings, gift/estate tax issues, and recent changes based on the Tax Cuts and Jobs Act (one example being the QBI deduction for miners).  Lastly, he will cover aspects of voluntary disclosure (whether domestic or foreign) and related IRS, Treasury, DOJ, and FATF campaigns.  Those who attend will gain a better understanding of the potential issues/solutions that a legal tax professional may encounter when faced with a client that has a U.S. cryptocurrency tax issue.
