An Introduction to Environmental Liability’s “Sleeping Giant” – Natural Resource Damages (NRD) Litigation 2019 *In-Person at D.C. Bar* (NEW)

Description: This informative and timely class will cover the fundamental concepts involved in natural resource damages litigation and assessment.  
Our knowledgeable and engaging faculty will distinguish between remediation (i.e., cleanup of pollution to meet risk-based standards) and restoration (i.e., cleanup and restoration of natural resources to return them to their pre-contaminated condition), as well as compensation for interim losses to the public.  They will discuss issues concerning legal standing to bring such claims, and various federal and state laws (including common law) that form the bases for doing so.  They will also discuss the scale of the historic recoveries obtained by federal and state trustees, including recoveries related to the Exxon Valdez oil spill, Deepwater Horizon event, and the contamination of groundwater by MTBE gasoline.  The class will conclude with a discussion of current and anticipated large scale claims for natural resource damages.  
While the class is designed to provide those who attend with an introduction to NRD litigation and damages concepts, attendees should have a basic familiarity with the applicable statutes and common law.
